DMCA Policy

GenPicz respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). This policy explains how to submit a copyright infringement notice and what happens when one is received.

1 Overview

GenPicz is a platform that enables users to generate images using AI. We take copyright infringement seriously. If you believe that content on our platform infringes upon your copyright, you may submit a DMCA takedown notice following the procedure described below.

We will respond to all valid notices promptly and take appropriate action, including removing or disabling access to allegedly infringing content and, in appropriate circumstances, terminating user accounts.

2 What to Include in a Takedown Notice

To be effective under the DMCA, your written notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorised to act on their behalf.
  2. Identification of the copyrighted work(s) claimed to have been infringed. If multiple works are covered by a single notification, provide a representative list.
  3. Identification of the material that is claimed to be infringing, with sufficient detail for us to locate it (e.g., URL or specific description of the content).
  4. Your contact information: name, address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material is not authorised by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorised to act on behalf of the owner.

Important

Submitting a false or misleading DMCA notice may expose you to legal liability, including claims under Section 512(f) of the DMCA for damages, costs, and attorney's fees.

3 How to Submit a Notice

Send your DMCA takedown notice to our designated copyright agent:

We strongly recommend sending notices by email for the fastest response. Please include "DMCA" in the subject line to ensure proper routing.

4 Our Response Process

Receipt & Review

We acknowledge receipt of your notice within 2 business days and review it for completeness.

Action

If the notice is valid and complete, we remove or disable access to the allegedly infringing content promptly, typically within 3–5 business days.

User Notification

We notify the user who posted the content about the takedown and explain the counter-notice procedure.

Counter-Notice

If the user submits a valid counter-notice, we notify you and may restore the content after 10–14 business days unless you seek a court order.

5 Counter-Notice Procedure

If you believe your content was removed in error or as a result of misidentification, you may submit a counter-notice. A valid counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material removed and its location before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, telephone number, email address, and a statement consenting to the jurisdiction of the courts of Portugal and/or the federal district court for your area.

6 Repeat Infringers

In appropriate circumstances, GenPicz will terminate the accounts of users who are found to be repeat infringers. We maintain a record of all valid DMCA notices received and take repeated infringement seriously.
