Terms of Service

Please read these Terms of Service ("Terms") carefully before using GenPicz. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. Service description

GenPicz is an AI-powered image generation platform operated by Sergio Henrique Assumpção (NIF 318727358), registered in Portugal. The service allows users to generate images from text prompts using artificial intelligence models.

2. Eligibility

• You must be at least 16 years of age to use GenPicz.
• By using the service, you represent that you have the legal capacity to enter into a binding agreement.
• Minors between 16 and 18 may use the service with parental or guardian consent.

3. Account registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorised use of your account.

4. Subscriptions and billing

4.1 Plans and pricing

GenPicz offers paid subscription plans (Starter, Pro, Studio) billed monthly or annually. All prices are displayed in euros (EUR) and include applicable VAT. Current pricing is available at genpicz.com/#pricing.

4.2 Payment processing

Payments are processed by Stripe, Inc. We do not store your card details. By subscribing, you authorise GenPicz to charge your selected payment method on a recurring basis until cancelled.

4.3 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for the unused portion of a billing cycle unless required by applicable consumer law.

4.4 Price changes

We reserve the right to modify pricing with at least 30 days' notice sent to your registered email address. Continued use of the service after the effective date constitutes acceptance of the new pricing.

6. Acceptable use

You agree not to use GenPicz to generate content that:

• Is illegal under any applicable law.
• Depicts, solicits, or promotes child sexual abuse material (CSAM) — this is a strict zero-tolerance policy and will result in immediate account termination and reporting to authorities.
• Contains explicit or graphic violence, gore, or hate speech targeting protected groups.
• Infringes any third party's intellectual property rights.
• Impersonates real individuals without their consent, including creating non-consensual intimate imagery (deepfakes).
• Is used for spam, fraud, or deceptive practices.
• Violates any person's privacy rights.

We reserve the right to remove content and terminate accounts that violate these rules without refund.

7. Intellectual property and image ownership

7.1 Your prompts

You retain ownership of the text prompts you submit.

7.2 Generated images

Subject to compliance with these Terms, images you generate are granted to you under a non-exclusive licence for personal and commercial use. GenPicz retains the right to use anonymised prompts and generated images to improve the AI models, unless you opt out in account settings.

7.3 Our intellectual property

The GenPicz platform, AI models, software, and all associated intellectual property remain the exclusive property of GenPicz / Sergio Henrique Assumpção.

8. Service availability

We aim to maintain 99.5% uptime. However, the service may be interrupted for maintenance, updates, or due to circumstances beyond our control. We are not liable for damages resulting from service interruptions.

9. Limitation of liability

To the maximum extent permitted by applicable law, GenPicz's liability is limited to the total amount paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

10. Termination

We reserve the right to suspend or terminate your account, with or without notice, for breach of these Terms. You may also terminate your account at any time. Upon termination, your right to access the service ceases immediately.

11. Modifications to terms

We may update these Terms from time to time. We will provide at least 30 days' notice of material changes via email to your registered address. Continued use after the effective date constitutes acceptance.

12. Governing law and disputes

These Terms are governed by the laws of Portugal. Any disputes shall first be referred to mediation. Consumer disputes may also be submitted to:

If mediation fails, the courts of Lisbon, Portugal shall have jurisdiction.
